We invite you to read the letter written by our senior associate of the Public Law and Regulated Markets Group, Gonzalo Bravo, where he refers to the recently approved Sectorial Permitting Framework Law in Congress.
Mr. Director:
The Chamber of Deputies dispatched the Sectorial Authorizations Framework Law, the last remaining procedure for the bill to be ready to become law. The management of expectations on the part of the companies will be crucial. No one in their right mind will implement modifications to their operations or base their business decisions on the text of this new legislation.
One key element is missing. The experience of its implementation. Let us not forget that the Energy Efficiency Law, as well as the Extended Producer Responsibility Law, are clear examples where a new regulatory framework requires adaptation not only for regulated entities, but also for regulators.
Indeed, the paradigm shift promised by this new law that reduces permit processing times will also be determined by how the authority will apply it. To ignore the discretion that different public agencies currently have in granting permits and/or authorizations is to ignore the complexity and reality of administrative procedures in Chile.
