Twitter/Threads case: Aspects to consider from the Chilean legislation

In just a few days, the launch of Threads, an application with similar characteristics to Twitter, by Meta, the company behind Instagram, became a worldwide phenomenon.

This has caused a great stir among users, considering that there was a general feeling of displeasure with the changes that Twitter had undergone since its acquisition by Elon Musk.

In this context, on July 5, Twitter sent a cease and desist letter, the contents of which have been leaked on social networks. In it, Twitter alleges that Meta has hired several former Twitter employees, who have allegedly used trade secrets to which they had access as employees for the development of the Threads application.

Considering the relevance of these applications in the market and the different regulations that converge in the conflict, namely intellectual property, industrial property and even possible actions for unfair competition, we will be attentive to the next steps taken by Twitter and the potential response of Meta.

Notwithstanding the above, we believe that this event allows us to highlight certain issues that are particularly relevant to the applicable regulation in Chile, understanding that in our experience the protection of businesses of this nature in similar contexts is a recurring concern for our clients.
