Is theft from a teleworker’s home considered a work-related accident or a common accident?

SUSESO concludes that the accident is of common origin and lacks the necessary causality to be considered work-related.

On October 29, 2025, the Social Security Superintendency (SUSESO) issued Ruling No. 149,525, requesting a ruling on the origin of an accident suffered by a teleworker as a result of a violent robbery at his home.

Specifically, on April 8, 2025, at around 12:45 p.m., a worker who was providing services from his home in telework mode was the victim of a violent robbery at his home, during which two individuals entered his home by force, leaving a third outside in the vehicle. These individuals robbed and physically assaulted him, resulting in the worker being injured.

In view of this situation, in the opinion of the Social Security Superintendency, we are dealing with an accident of common origin, since “it follows that for an accident at work to be considered as such, there must be a causal relationship between the injury and the work activity, which may be direct or immediate, constituting an accident ‘due to’ the work, or indirect, in which case the event will be an accident ‘on the occasion of’ work, and the causal link must be established beyond doubt.”

In summary, the verified risk—the theft—occurred not because the worker was providing services in a teleworking mode, but rather because of the residential nature of the place where the worker was located, and therefore the causal relationship required for the incident to be classified as a work-related accident did not exist.

Consequently, the theft “does not imply even an indirect occupational risk, but rather a domestic and environmental risk, and therefore the incident should not be classified as a work-related accident.”
